BC Rent Increase 2026: 2.3% Cap Calculator (RTB)

A text that says “3.5% like last time” is using the 2024 number. The Branch’s own table is 2.3% for 2026. Unused room from a year they skipped does not carry forward. This is a calculator and a draft letter — not a lawyer, not a $30k badge, not a $100 lead form.

Section 51 is two different cheques

s.51(1) — A tenant who receives a section 49 (landlord's use) notice is entitled to one month's rent as compensation, or may withhold the last month. s.51(2) — Twelve months of rent is extra compensation only if the landlord or purchaser does not establish that they accomplished and used the unit for the stated purpose (generally 12 months of use). It is not automatic on every personal-use notice. The director can excuse payment for extenuating circumstances. RTA s.51(2)–(3).

FAQ

Is the 2026 cap 3.5%?

No. 3.5% was 2024. 2025 was 3%. 2026 is 2.3% and 2027 is already published at 2.2%. Source: the Province of B.C. rent-increase page, updated 27 August 2026.

Does a fake 'landlord moving in' notice automatically pay 12 months of rent?

Twelve months of rent is extra compensation only if the landlord or purchaser does not establish that they accomplished and used the unit for the stated purpose (generally 12 months of use). It is not automatic on every personal-use notice. The director can excuse payment for extenuating circumstances. RTA s.51(2)–(3). One month under s.51(1) is the amount that comes with a valid s.49 notice.

Can I refuse to pay any increase?

A lawful RTB-7, three full months’ notice, 12 months since the last increase, and 2.3% or less is generally collectable. Paying more than the cap is the part to fight. Apply to the Residential Tenancy Branch — it is free. This site does not sell a paralegal lead.
